Removal of trustees – Wallace v Naknok

Where a deed does not provide for the removal of trustees, it is not possible to remove a trustee without the assistance of the High Court.  However, as that assistance is only available pursuant to the High Court’s inherent jurisdiction, the court will only remove a trustee where this is necessary for the welfare and benefit of the beneficiairies and the trust property.  See removal of trustees.
