The Government has released its response to the Law Commission report, Review of the Property (Relationships) Act 1976 Te Arotake i te Property (Relationships) Act 1976, which was presented to Parliament on 23 July 2019.
The report has recommended that the rules applying to relationships ending on death be examined within the context of a broader review of succession law, which is now under way.
The Government response is that it intends to consider the report’s remaining recommendations after the completion of the Law Commission’s review of succession law so that consideration can be undertaken on the two topics concurrently.
Editor’s note: given the common interplay between trusts, succession and relationship property it is suggested that a response that includes a review of the use of trusts should be promoted.
